In order to be able to travel on the road with agricultural machinery, what legislation should be referred to?

In order to take to the road with agricultural machinery it is necessary to refer to the Highway Code (Legislative Decree 285/92 and subsequent amendments and additions) and to relative implementing Regulations (Presidential Decree 495/92 and subsequent amendments and additions), which include provisions on procedural, administrative and manufacturing aspects for machinery and conduct on the road.

What support does Enama give to agricultural workers on the subject of road circulation?

Enama has drafted a specific document, containing a summary of the complex rules for road circulation, aimed at agricultural workers. It is also possible to ask specific questions directly through our site. For machine manufacturers there is an advice service for obtaining type approval for road circulation.

Will the Highway Code be revised in the near future with reference to agricultural machinery in particular?

On this point Enama, through a draft legislative decree, has put forward a proposal for changes to the Highway Code and relative Regulations. This proposal was officially submitted by the Ministry for Agricultural and Forestry Policies to the Ministry of Infrastructures and Transport. Thus far no action has been taken. It is therefore believed that changes, although necessary, will not happen in the near future. Recent changes made to the Code and its Rules have only marginally affected the sphere of agricultural machinery.

Can a truck be registered as an agricultural tractor?

In general, a truck may not be registered as an agricultural tractor. The vehicles you refer to are actually agricultural tractors with loading platforms, as defined in the current Highway Code, which lays out their manufacturing specifications.
These vehicles, then, may be registered in any Italian province as agricultural tractors only if they are officially classified as agricultural tractors with loading platforms.

I would like to buy a new tractor for private/recreational use. The dealer I contacted told me I would need to be registered for corporation tax, so I would like to know if this is actually the case. I'm not a farmer, I am an employee working outside the farming industry. If I do have to register for corporation tax, what is the relevant legislation?

Article 110 of the Italian Highway Code (Italian Legislative Decree 30/04/1992, No. 285 and subsequent modifications and updates) states that any piece of agricultural machinery must be registered in the name of the individual who declares him or herself to be the owner of the equipment, in the name of the owner of a farming or forestry company, in the name of the owner of a company that carries out agromechanical works or the leasing of agricultural machinery, or in the name of a public body or consortium. As indicated by the dealer, agricultural machinery may not be registered by any individual other than those stated above.

Where would I find regulations on the driving of agricultural machinery? What do they say?
The regulations of the driving of agricultural machinery are contained in Article 124 of the Highway Code. They include the possession of a Category A driving licence for those intending to drive the agricultural machinery indicated in Article 115, Paragraph 1, Letter C - i.e. any agricultural machinery (including towed equipment) that falls within the following upper limits:
- 1.60m wide
- 4.00m long
- 2.50m high
- 1.3t (total weight)
- speed 40 km/h
No passengers are permitted on board.
Anyone intending to drive any agricultural machinery, including machines that do not conform to the above specifications, is required to be in possession of a Category B licence.
